Limited Warranty:
VistaMounts LLC Inc. (VistaMounts”) warrants that this Product, (including any and all accessories, will be of the kind and quality described in the order or contract and will be free of) defects in material or workmanship. Should any failure to conform to this Warranty appear VistaMounts shall, on notification, correct such nonconformity, including nonconformance with the specifications, as follows:

1. PARTS: For a period of two (2) years from the date of purchase, if this Product is determined to be defective, VistaMounts will repair or replace the defective Product, part or parts, at its option, at no charge. After the two (2) year Warranty period has expired, the buyer is required to pay for all replacement part or parts.
2. LABOR: VistaMounts will provide the labor to install new or rebuilt replacement parts or pay the labor charges to any VistaMounts authorized service facility, at its option, at no charge to repair parts determined to be defective for a period of one (1) year from the date of purchase. After the one (1) year Warranty period has expired, labor related to repair any defective part or parts of the Product is at the buyer’s expense.

To obtain Warranty service, the Product or defective part(s) for which a Warranty claim is made, are to be returned transportation prepaid, in either its original packaging or packaging affording an equal degree of protection, to any authorized VistaMounts service facility. VistaMount’s obligation under this Warranty shall not include any transportation charges or costs of installation or any liability for direct, indirect or consequential damages or delay.
Proof of purchase in the form of a bill of sale or receipted invoice, which is evidence that the Product is within the Warranty period, must be presented to obtain Warranty service. This Warranty is invalid if the factory applied serial number has been altered or removed from the Product.
VistaMounts shall not be liable for special, indirect, or consequential damages. Under no circumstances shall the liability of VistaMounts exceed the purchase price of the Product or accessories purchased by the customer. This Warranty does not cover customer instruction, damage incurred during shipping, damage incurred during unpacking, damage incurred during installation, or set up adjustments. This Warranty shall not apply to any Product or accessories misused by the customer, nor to any Product or accessories made by VistaMounts that are not operated in accordance with their printed instructions or that have been operated beyond the rated capacity of the goods. The Warranty does not cover damage due to improper operation or maintenance, damage due to connection to improper voltage supply, substitution of parts not approved by VistaMounts or any alteration, damage or repair done by anyone other than a facility authorized by VistaMounts. This Warranty does not cover Products or accessories sold “AS IS” or “WITH ALL FAULTS,” or consumables (such as fuses or batteries). No employee or representative of VistaMounts is authorized to change this Warranty in any way or grant any other warranty.
This Warranty is non-transferable. The goods purchased under this agreement shall be used exclusively by buyer and by no other person, and there shall be no third party beneficiary to the express or implied warranties contained in this agreement.
THERE ARE NO WARRANTIES, REPRESENTATIONS, OR CONDITIONS OF ANY KIND WHICH EXTENDED BEYOND THE DESCRIPTION ON THE FACE HEREOF. CORRECTION OF NONCONFORMITIES, IN THE MANNER AND FOR THE PERIOD OF TIME PROVIDED ABOVE, SHALL CONSTITUTE FULLFILLMENT OF ALL LIABILITIES OF VISTAMOUNT TO BUYER, WHETHER BASED ON CONTRACT, NEGLIGENCE, OR OTHERWISE WITH RESPECT TO, OR ARISING OUT OF SUCH EQUIPMENT. THE REMEDIES SET FOURTH IN THIS INSTRUMENT ARE EXCLUSIVE, AND THE LIABILITY OF VISTAMOUNT WITH RESPECT TO ANY CONTRACT OR SALE OR ANYTHING DONE IN CONNECTION WITH THE SAME, WHETHER IN CONTRACT, IN TORT, UNDER ANY WARRANTY, OR OTHERWISE, SHALL NOT, EXCEPT AS EXPRESSLY PROVIDED IN THIS INSTRUMENT, EXCEED THE PRICE OF THE EQUIPMENT OR PART ON WHICH SUCH LIABILITY IS BASED. VISTAMOUNTS MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, AND MAKES NO WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR ANY PARTICULAR PURPOSE.
